Connecticut consumers who purchased certain generic prescription drugs between May 1, 2009, and December 31, 2019, may be eligible for payments following an additional settlement reached with Glenmark Pharmaceuticals, Inc., USA, in ongoing litigation over alleged generic drug price-fixing.
The lawsuits, brought by state attorneys general, including Connecticut Attorney General William Tong, allege that Glenmark and other generic drug manufacturers unlawfully agreed to fix prices of numerous generic prescription drugs sold in the United States, causing purchasers to potentially pay more than necessary. The lawsuits do not question the safety or effectiveness of any drugs at issue. Lawsuits continue against non-settling defendants including Teva, Pfizer, Sandoz, and Mylan, among others.
Consumers are included if they purchased a generic prescription drug from a defendant manufacturer, the drug is among those named in the lawsuit, the purchase occurred within the eligible period, and they reside in a participating state or territory.
Glenmark has agreed to pay approximately $29.6 million into a Settlement Fund, with $20.7 million set aside for distribution to consumers and $8.9 million set aside to finance settlement administration and reimburse state attorneys general for litigation costs. Money will not be distributed until a Plan of Allocation is approved by the court at a later date. State attorneys general will continue pursuing lawsuits against non-settling defendants, with additional settlement money expected to be added to the fund for future distribution.
The claims process will open at a later date, requiring a claim form that will become available through the settlement website and other means. Consumers who wish to exclude themselves from the settlement must do so by October 15, 2026, and a court hearing to consider approving the settlement is scheduled for November 5, 2026.
